CAMBIAR UN PRODUCTO


Se entiende por \"Cambiar\" la sustitución de un producto por otro distinto, color y/o talla.

Para concretar el cambio debes ponerte en contacto con nosotros a través del email info@nightbra.com o bien por teléfono al 667 985 043 (prefijo 0034 desde fuera de España; 01134 prefijo desde U.S.A. y Canadá).

PLAZO Y CONDICIONES DE CAMBIO

Siempre puedes cambiar un producto que se encuentre en las mismas condiciones que lo recibiste. Igualmente puedes cambiar o devolver un producto que se encuentre defectuoso.En ambos casos, la Ley (Directiva Europea 97/7/CE) obliga a un plazo mínimo de 14 días naturales contados desde la recepción del producto.En el caso de que el producto esté \"probado\" tienes 7 días naturales para enviarlo, y en nuestra fábrica se analizará su estado una vez recibido, y te ofreceremos una solución adecuada; que podrá ser el cambio por otro producto

Debes enviar el producto a nuestras oficinas por Correo Certificado con el fin de asegurar su correcta recepción.

En el caso de encontrarse el producto en perfectas condiciones, y una vez recibido se te enviará el nuevo producto al domicilio sin gastos de envío adicionales. Sólo deberás pagar la diferencia de precios, si la hubiese, por haber cambiado de modelo o talla, y los gastos de envío desde tu domicilio a nuestras instalaciones.

Si el producto no se encontrase en óptimas condiciones, tú responderás de toda disminución de valor de los productos que sea resultante de una manipulación de los mismos distinta a la necesaria para establecer su naturaleza, sus características o su funcionamiento.

Los productos que hayan sido devueltos dañados, incompletos, deteriorados, usados o sucios por causa ajena a Nightbra no serán reembolsados y serán puestos a disposición de su remitente y reenviados a portes debidos.

En caso de cambio de producto con diferencia de precio a tu favor se te devolverá el importe tras la aprobación de la operación. La devolución se realizará en unos días y del mismo modo en que se hizo el pago. Así, si hiciste el pago online se te abonará a tu tarjeta. Si realizaste el pago contrareembolso la devolución se realizará por transferencia.

Nightbra se reserva el derecho de rechazar cambios comunicados o enviados fuera del plazo fijado, o prendas que no se encuentren en las mismas condiciones en las que fueron recibidas.

Se entiende por \"Devolver\" el rechazo del producto recibido sin obtenerse otro a cambio.

Siempre puedes devolver un producto si así lo deseas, y sin razón que te justifique, siempre que el producto se encuentre en las mismas condiciones en que lo recibiste y sin haber sido usado o devolver un producto que se encuentre defectuoso.

El plazo de cualquier devolución es de 14 días naturales después de la recepción del producto y se aplicará el Derecho de Desistimiento (Directiva Europea 97/7/CE). En las condiciones indicadas (idénticas condiciones que lo recibido o por tara del producto) se te realizará un abono íntegro de lo pagado.

En el caso de que el producto esté \"usado\", tienes 7 días naturales para enviarlo, y en Nightbra se analizará su estado una vez recibido, y te ofreceremos una solución adecuada; que podrá la devolución de lo pagado total o parcialmente. En estos casos los gastos de envío correrán por tu cuenta.

Debes enviar el producto a nuestras oficinas por Correo Certificado con el fin de asegurar su correcta recepción .

Una vez confirmado que el producto se encuentra en perfectas condiciones (y con el precinto puesto en el caso de ropa interior) se realizará el abono integro de lo que pagaste, excepto los gastos de envío.

Si el producto no se encontrase en óptimas condiciones, tú responderás de toda disminución de valor de los productos que sea resultante de una manipulación de los mismos distinta a la necesaria para establecer su naturaleza, sus características o su funcionamiento.

Para productos en perfectas condiciones, la devolución se realizará en unos días y del mismo modo en que se hizo el pago. Así, si hiciste el pago online se abonará a tu tarjeta. Si realizaste el pago contrareembolso la devolución se realizará por transferencia a la cuenta que nos indiques.

Recibirás un email indicándote que el abono ha sido realizado. Recuerda que los abonos no se reflejan en tu cuenta inmediatamente, el tiempo depende siempre de tu entidad bancaria.

En caso de no hallarse el producto en óptimas condiciones nos pondremos en contacto contigo para acordar la resolución de la situación.

Nightbra.com se reserva el derecho de rechazar devoluciones comunicadas o enviadas fuera del plazo fijado, o prendas que no se encuentren en las mismas condiciones en las que fueron recibidas.

DERECHO DE DESISTIMIENTO


El desistimiento es la facultad de un consumidor o usuario, según el concepto establecido por el Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias, de desistir de la compra de un bien para devolverlo al comercio dentro de un plazo legal de 14 días naturales, sin tener que alegar ni dar ninguna explicación al respecto ni sufrir una penalización. El plazo comienza a contar desde la recepción del producto (normalmente, desde la firma de la Entrega del Producto, que nos hará firmar el mensajero que nos lo entregue).

En caso de desistimiento por su parte, Nightbra le reembolsará todo pago recibido por usted, incluidos, en su caso, los costes de entrega. Sin perjuicio de lo anterior, en caso de que se desee la devolución por una modalidad distinta de la propuesta por nosotros (similar a la entrega) no le reembolsará los costes adicionales que de ello se deriven.

Si el destinatario de los productos es distinto de la persona que efectuó el pago, el reembolso del dinero se le hará a la persona que efectuó el pago.

El derecho de desistimiento será aplicable siempre y cuando los productos se devuelvan en las mismas condiciones en las que usted los recibió, junto con su embalaje original completo, etiquetas y junto con cualquier accesorio relacionado con los mismos. Para el cambio o devolución de artículos de ropa interior es imprescindible que se conserve intacto el precinto de seguridad, según el Artículo 103-c de la citada Ley:

El desistimiento no será aplicable en el suministro de bienes precintados que no sean aptos para ser devueltos por razones de protección de la salud o de higiene y que hayan sido desprecintados tras la entrega.

Si su devolución no cumple con los términos estipulados, no tendrá derecho a recibir ningún reembolso de importe.

Nosotros determinaremos si los productos se encuentran en las mismas condiciones en las que le fueron enviados. Usted responderá de toda disminución de valor de los productos que sea resultante de una manipulación de los mismos distinta a la necesaria para establecer su naturaleza, sus características o su funcionamiento. Los productos que hayan sido devueltos dañados, incompletos, deteriorados, usados o sucios por culpa del cliente no serán reembolsados y serán puestos a disposición de su remitente y reenviados a portes debidos.
