CHANGING A PRODUCT


By “change”, we understand the replacement of a product for a different product or the same type of product with a different colour/size.

In order to agree on the terms of the change, write us an email to info@nightbra.com or call us: 667 985 043 (prefix 0034 from outside Spain or 01134 from the US and Canada).

TERMS AND CONDITIONS FOR CHANGES

You can always change a product as long as it is in the same conditions as when you received it. You can also change or return a defective product.
If you have tried the product, you have 7 calendar days to send it back and our factory will analyse its conditions. Once it has been received, we will offer you the best solution, which will be either the change for another product paying part of it or without paying anything as per the condition of the product (excluding shipping costs).

If we receive the product in perfect conditions, we will send the new product to your home with no extra shipping costs. You will only have to pay the price difference, if any, for changing model or size, as well as the shipping costs.

If the product is not in the best conditions, you will respond for any value loss of the products caused by any use of the products other than that needed to establish their nature, their characteristics or their operation.
If the returned products are damaged, incomplete, deteriorated, used or dirty for any reason external to Nightbra, their prices will not be reimbursed and they will be returned to the sender with unpaid shipping costs.

If the change of a product involves any positive price difference for you, it will be paid to you once the operation has been approved. The return of the money will take a few days and it will be done by the same means used to make the payment. If you paid online, the money will be returned to your card. If you paid by COD payment, the return will be done by wire transfer to the account indicated by you.

Nightbra.com reserves the right to reject returns communicated or shipped out of the established term or if clothes are received in a different condition than that in which they were shipped to the customer.
The articles to be returned or exchanged must be in the same condition in which they were received

TERMS AND CONDITIONS FOR RETURNS

You can always return a product if you wish to and with no justification as long as the conditions of the product haven’t been altered, it hasn’t been used or it is defective.

The returning period lasts for 14 calendar days after receiving it and the Right of Withdrawal (European Directive 97/7/EC) will be applied. If the product keeps the indicated conditions (they haven’t been altered since the product was received or it is defective), the paid amount will be fully reimbursed.

If the product has been used, you have 7 days to send it and Nightbra will analyse its condition once it has been received; after that, we will offer you a solution (the partial or total return of the amount paid). In both cases, the shipping costs will be paid by you.

Once we have received the product in our offices, we will proceed to check its condition and we will contact you.
For products in perfect conditions, the return of the money will take a few days and it will be done by the same means used to make the payment. If you paid online, the money will be returned to your card. If you paid by COD payment, the return will be done by wire transfer to the account indicated by you.

You will receive an email indicating the payment. Please note that the payments in your account are not displayed immediately and the time it takes for them to be displayed depends on your bank.

If the product is not in perfect conditions, we will contact you to agree on a solution.

RIGHT OF WITHDRAWAL


RIGHT OF WITHDRAWAL

The right of withdrawal is the right of any user or consumer, as per the concept established by the Spanish Royal Legislative Decree 1/2007 approved by the consolidated text of the Spanish Law on Consumer Protection and other legislation to withdraw from the purchase of a good or return it within the legal term of 14 calendar days without needing to give any explanation about it and with no punishment for it. The term starts to count when the product is received (normally the date on the delivery note signed by the receiver).

If you use your right to withdraw, Nightbra will give you back every payment received from you including, if any, the shipping costs. Notwithstanding the foregoing, if you have the product return through any means other than that suggested by us (similar to that of the delivery) you will be reimbursed the extra costs deriving from it.

Even if the receiver of the products not the person who made the payment, the reimbursement will be done to the payer.

The right of withdrawal will be applicable as long as the products are returned in the conditions they were received along with their full packaging, tags and with any related accessory. For the change or return of underwear, the security seal must be intact, as established on Art. 103-C of the abovementioned Spanish Law:

“The right of withdrawal will not be applicable to goods with security seal which cannot be returned for the sake of health or hygiene and which have been unsealed after being delivered”.

If your return does not fulfil the established terms and conditions, you will not be entitled to receive any reimbursement of the paid price. We will determine if the products are in the same conditions as when they were sent and, if the product is not in the best conditions, you will respond for any value loss of the products caused by any use of the products other than that needed to establish their nature, their characteristics or their operation. If the returned products are damaged, incomplete, deteriorated, used or dirty for any reason external to Nightbra, their prices will not be reimbursed and they will be returned to the sender with unpaid shipping costs.
