1. Right of Withdrawal (First 14 days)
- Legal Deadline: You have 14 calendar days from the receipt of your order to request an exchange or return without needing to justify the reason (Right of Withdrawal, RDL 1/2007).
- Conditions:
- The product must be returned in the same condition as it was received, unused, and with its security seal intact in the case of underwear.
- Items that are damaged, used, without tags, or lacking their original packaging will not be accepted.
- In the event of an original defect or a shipping error, Nightbra will cover all shipping and transport costs.
- Exceptions: For hygiene and health protection reasons, returns of underwear whose security seal has been opened or tampered with after delivery will not be accepted (Art. 103.e of the Spanish General Law for the Defense of Consumers and Users).
- How to request it: Please contact us at info@nightbra.com or by phone at +34 667 985 043. We will explain how the process works. Once the return is arranged, you must send the product to our offices via Certified Mail (Registered Post) to ensure its proper tracking and receipt. Return shipping costs are at your expense, and under no circumstances will returns sent cash on delivery (C.O.D. / portes debidos) be accepted. Once the product is received at our offices, we will verify its condition and proceed with the refund of the product amount.
2. Legal Product Warranty (Up to 3 years)
In accordance with Spanish Royal Decree-Law 7/2021, all our new products come with a 3-year legal warranty against lack of conformity or original manufacturing defects.
- Reversal of the Burden of Proof (From the second year onwards): As dictated by current regulations, during the first 2 years, it is presumed that any defects that manifest are original. Once 24 months have passed since the delivery of the goods, this presumption expires, and it becomes the buyer's responsibility to prove that the failure is due to a structural manufacturing defect and not to continuous use or maintenance of the item.
- Warranty Exclusions: The legal warranty strictly covers previous production faults. The following are completely excluded from this coverage:
- Natural wear and tear due to accumulated use of the product or the passage of time on elastic components (material fatigue).
- Damage resulting from incorrect use, mechanical overstrain, or improper pulling/stretching of the fabric (such as digging fingers into the fabric when putting on or taking off the garment).
- The use of a smaller size than recommended based on the user's anatomical measurements, which subjects the fabric to excessive tension beyond its intended design.
- Deterioration caused by poor maintenance or improper washing, including exposure to direct heat sources or the use of aggressive chemical agents (such as fabric softeners, bleach, or whiteners) that chemically degrade and break down elastane polymers.
