TERMS OF PURCHASE
1. Purpose
This document regulates the use of this website and the purchase of products through it. By placing an order, you accept these Terms, which form part of the contract between Méndez Chaín S.L. (hereinafter, “Nightbra”) and the customer.

3. Website Use
By using this website, you agree to:
- Place only valid and truthful orders.
- Not place false or fraudulent orders.
- Provide accurate and complete contact details.
- The customer declares to be over 18 years old and legally capable of entering into contracts.
4. Purchase Process and Acceptance
To purchase, you must add products to the cart, process the order, provide shipping details, and confirm payment.
- You will receive an Order Confirmation email (acknowledging receipt).
- The contract is finalized when we send you the Shipping Confirmation email.
- Only the products confirmed in that email will be part of the contract.
5. Availability
All orders are subject to product availability. If an item is out of stock, you will be informed and may:
- Accept an alternative product of equal or greater value, or Cancel the order with a full refund.
6. Prices and Payments
- Prices shown on the website are final at the time of purchase.
- As the company is based in the Canary Islands, orders to mainland Spain and the EU may be exempt from VAT but subject to local taxes or customs duties depending on the destination.
- In case of a pricing error, you will be notified to either confirm or cancel the order.
- Payment must be completed before shipping.
7. Delivery
Estimated delivery times are shown in the Shipping section.
- If we cannot meet the estimated date, you will be notified and may choose to continue with a new delivery date or cancel for a full refund.
- Delivery will be considered completed once the order is signed for at the specified address.
- If delivery is not possible within 15 days for reasons not attributable to Nightbra, the contract will be considered canceled and payment refunded within 14 days (minus any additional costs, if applicable).

9. Warranties and Liability
- Nightbra guarantees product conformity according to the 3-year legal warranty (Art. 120 Spanish Consumers Act).
- Our liability is limited to the purchase price, unless otherwise required by law.
- We are not liable for indirect losses (loss of profit, data, business opportunities, etc.).
10. Communications
All communications will be primarily made by email. The customer accepts this electronic means as legally valid.
11. Force Majeure
We will not be responsible for delays or failures caused by circumstances beyond our reasonable control (strikes, natural disasters, pandemics, technical failures, etc.).
12. Modifications
We may update these Terms at any time. The Terms applicable will be those in force at the time of your order.
13. Applicable Law and Jurisdiction
These Terms are governed by Spanish and EU law.
In case of dispute, the parties submit to the Spanish courts, without prejudice to the consumer rights available in your country of residence.
